Terms & Conditions

The purpose of these Terms and Condition is to outline the framework in which you will use the Services provided by I’m Negative Lab. Your use of the Services shall be held as an express agreement that you are willing to be bound by these Terms and Conditions. If you do not agree to any of the Terms and Conditions, you may not use any of the Services.

I’m Negative may change or modify these Terms and Conditions from time to time for any reason and at its sole discretion. Any change or modification to these Terms and Conditions shall come into effect simultaneously upon publication on this Website. Your use of the website services constitutes an agreement that you are willing to be bound by the revised Terms and Conditions. Hence, we advise you to frequently check these Terms and Conditions to monitor any changes or modifications. 

Definitions

“I’M NEGATIVE”We” shall mean I’M NEGATIVE LAB, the provider of the Services.

“Client” “You” shall mean any individual that registers on the Website and/or uses the Services.

“Website” shall mean WWW.ANASALBI.COM through which Clients can book appointments and pay for the Services.

“Services” shall mean the testing for Covid-19 through both PCR and Anti-Body tests. 

“Result” shall mean the result of the Covid-19 testing.

“Personal Information” “Data” shall mean any information provided to I’M NEGATIVE by the Client including (name, address, civil ID, passport details, email, mobile number, any previous medical history, and any information required by I’M NEGATIVE to provide any of the Services.

These Definitions shall also apply to the Privacy Policy. 

Scope of Services

I’M NEGATIVE LAB has provided this website to cater Covid-19 testing services for clients at its premise or through home visits. Considering the nature of Covid-19 testing’s, the Services include three types of PCR tests and one Anti-Body test. The PCR tests include General, Travel and Travel with Insurance.

For those valued Clients who wish to pre-book an appointment for any of the Services, we have provided this Website to cater appointment services where Clients can book and pay for Service in advance. 

The Client may choose any of the Services available on the Website and book an appointment through the Website by first providing the relevant information listed on the Website and then proceed to pay online for the Services. Upon payment, the Client shall receive the appointment details via SMS and payment receipt via email.

The Services’ result shall be sent to the Client in accordance with reasonable time while taking into consideration those instances where there is a high increase in demand and how that affects result times.  

Legal Capacity

By using this Website, you hereby declare that you have reached the age of maturity in accordance with the Laws of Kuwait and have the legal capacity to agree to these Terms and Conditions.

Appointments

Upon payment of the desired Services, an appointment will be generated automatically and sent to the Client via SMS and the payment receipt by email. The Client is expected to be present at I’M NEGATIVE LAB on the time of the appointment with a proof of identity (I.e Civil ID/ passport or license) for verification purposes.  

Cancellation and Rescheduling

The Client may cancel an appointment by notifying I’M NEGATIVE LAB of the cancellation within (7) days prior to the scheduled appointment date/ time. Any no show will be treated as a cancellation and shall forfeit the right for a refund unless the Client wishes to reschedule for future use.

  • Refunds can be collected and redeemed in CASH only from 9 AM to 5 PM starting Sunday to Thursday from Head office located in Sabah Al Salem.
  • Refunds requests are processed in 7 working days once reported for cancellation etc.
  • Refunds requests must only be claimed/redeemed by the same Client for cancellation and refund except children for an identity verification purposes.
  • Refunds requests will only be processed with a proof of payment to I’M NEGATIVE via bank account.

The Client may reschedule an appointment by contacting I’M NEGATIVE LAB via Call Center 1800280 prior to the appointment and a new appointment will be communicated to the Client via SMS. 

 

Payment and Refund policy

The Services shall be provided on a pre-paid basis and no cash payments will be accepted. For pre-booked appointments, Clients will only receive appointment details and confirmation upon payment receipt. 

We fully understand the possibility of a delayed result and the potential issues that may cause to our valued Clients. Therefore, I’M NEGATIVE LAB shall refund the Client in the following cases:

  • If the result is not released within 12 hours or exceed 12 hours, the Client can report to I’M NEGATIVE LAB within 7 days and claim for an entitlement of 50% refund.
  • If the Client pays for the Traveler result and the result delay exceed 12 hours causing the Client to miss their flight (provided the Client conducted the test within the official announced TAT), then the Client is entitled for a full refund and shall be compensated against the missed flight with the pro rata fees required to change the flight ticket.
  • If the Client pays for the Traveler result and the result delay exceed 12 hours causing the Client to miss their flight that is Non Refundable / Non Changeable due to No show as per the airlines rules & regulations, (provided the Client conducted the test within the official announced TAT), then the Client is entitled for a full refund and shall be compensated against the missed flight with the proof of ticket amount paid to the Travel Agents or Airlines through their bank account and with the pro rata fees.
  • If the Client pays for the Traveler result and the result is delayed due to data entry mistake, causing the Client to miss their flight, then the Client is entitled for a full refund in addition to a free of charge PCR test and shall also be compensated against the missed flight with the pro rata fees required to change the flight ticket.

This refund policy outlines the only instances where Clients are entitled for refunds and compensations. This refund policy shall apply to all Services performed by I’M NEGATIVE Services can be performed on demand at I’m NEGATIVE LAB premise or by virtue of pre-booked appointments using this Website. 

Clients must notify I’M NEGATIVE of the refund claim within 7 days from the date of delayed for PCR result. Any notification after 7 days shall forfeit the right for a refund unless the Client wishes to reschedule for future use.

 

Accuracy of Information

The Client warrants that the Personal Information provided on the Website is accurate, complete, true, and up to date at the date of entry. The Client shall be responsible on notifying I’M NEGATIVE LAB upon any changes to the Personal Information post any Appointment booking within adequate time for I’M NEGATIVE LAB to perform all necessary changes.

Please read the information provided in this page (hereinafter referred to as “Disclaimer”) carefully before you use this Website. If you do not agree to any of these terms you may not use the Services available on the Website. Your use of the Website constitutes a declaration from you that you agree to be bound by these terms.

This Website is run and managed by I’M NEGATIVE LAB and it provides a platform to book and pay for PCR and Anti-Body appointments at I’M NEGATIVE LAB’s premises. For you to use the Services you must provide I’M NEGATIVE LAB with information such as your name, email, address and civil id number and other information that the Website may ask for (the “Personal Information”). 

I’M NEGATIVE LAB SHALL NOT BE RESPONSIBLE FOR ANY INCORRECT PERSONAL INFORMATION PROVIDED BY THE CLIENT AND ANY LOSS OR DAMAGE OR INJURIES AS A RESULT THEREOF AND ANY CHANGES TO THE PERSONAL INFORMATION PROVIDED AFTER REGISTRATION. I’M NEGATIVE LAB SHALL NOT BE LIABLE FOR ANY CLAIM OR LOSS RESULTING FROM THE USE OF THE WEBSITE’S SOFTWARE IN ANY WAY THAT MAY CAUSE DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THIS DISCLAIMER SHALL ONLY APPLY TO THE SERVICES PROVIDED IN THIS WEBSITE AND NOT TO ALL I’M NEGATIVE LAB ACTIVITIES AND SERVICES.

Data usage

Your use of Website is subject to the terms under the Privacy Policy. Please refer to the Privacy Policy to know how I’M NEGATIVE LAB will manage, store, and handle all Data you provide on the Website or while receiving any of the Services.

Indemnification

The Client agrees to indemnify and hold I’M NEGATIVE LAB and its suppliers, affiliates, employees, officers, directors, agents, insurers, and representatives harmless from and against any loss, damage, or injury whether direct, indirect, consequential, or incidental or as a result of using the Website or the Services in any unconscionable way or in a way that is not justifiable by law.

Limitation to Liability

I’M NEGATIVE LAB shall not be liable against any indirect, special, incidental, or consequential damages, including but not limited to loss of profits, lost time, harm, injury or claim from using the Website or as a result of any incorrect Personal Information provided by the Client on the Website or in the course of receiving any of the Services.

Intellectual property rights

We own all intellectual, subsidiary, and adjacent rights, as well as any ideas, techniques, improvements or requests for service improvement, opinions, and recommendations. The name and logo of the company owning the website represent trademarks owned by us and our allies or subsidiaries, as it may be. We do not authorize the use of such marks by third Parties unless there is an agreement between us and any third Party.

Notifications

Notwithstanding notices of rescheduling an appointment, all notifications and notices are to be communicated via the EMAIL-PHONE NUMBER which the Client provides.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Kuwait and any disputes arising thereof shall be under the jurisdiction of the relevant Kuwaiti courts.
